These Terms of Service (“Terms”) govern your access to and use of DocSift (available at doc-sift.com), operated by DocSift (“DocSift,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What DocSift Does
DocSift is a document processing and analysis platform. You upload documents (PDFs, images, Word files, text files), and our Service uses artificial intelligence to extract structured data, answer questions about your documents, and export results.
DocSift processes your documents using third-party AI models (currently Anthropic’s Claude). When you upload a document, its text content is sent to this AI provider for analysis. By using DocSift, you consent to this processing. See our Privacy Policy for details on how your data is handled.
2. Account Terms
2.1 Eligibility. You must be at least 16 years old to use DocSift. By creating an account, you represent that you meet this requirement.
2.2 Account Security. You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@doc-sift.com if you believe your account has been compromised.
2.3 Accurate Information. You must provide accurate and complete information when creating your account and keep it up to date.
2.4 One Person, One Account. Each account is for a single individual. You may not share your account credentials with others. Team plans (when available) provide multi-user access.
3. Plans and Limits
DocSift offers Free and paid plans. Each plan has limits on the number of workspaces, documents, pages, and queries you can use. Current plan details are available at doc-sift.com.
We may change plan features and limits at any time. If we reduce limits on a paid plan, the change will not take effect until your next billing cycle, and we will give you at least 30 days’ notice.
4. Acceptable Use
You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms.
In summary, you may not use DocSift to:
- Upload documents you do not have the legal right to possess or share
- Upload content that contains child sexual abuse material or exploits minors in any way
- Upload stolen or illegally obtained documents
- Upload documents with the intent to harm the individuals named in them
- Attempt to attack, disrupt, or reverse-engineer the Service
- Circumvent usage limits or access controls
- Use the Service in any way that violates applicable law
We may suspend or terminate your account if you violate these terms.
5. Your Content
5.1 Ownership. You retain all ownership rights in the documents you upload and the data you create within DocSift. We do not claim ownership of your content.
5.2 License to Us. By uploading documents, you grant DocSift a limited, non-exclusive license to process, store, analyze, and display your content solely to provide the Service to you. This license ends when you delete your content or your account.
5.3 No IP Claims by DocSift. We claim no intellectual property rights over your documents or the data extracted from them. Your content remains yours. The AI-generated outputs (extractions, summaries, chat responses) derived from your documents are provided to you as part of the Service. We do not use your content or its derivatives for any purpose other than providing the Service to you.
5.4 Your Responsibility. You are solely responsible for the documents you upload. You represent that you have all necessary rights and permissions to upload each document and to have it processed by AI. If you upload documents belonging to clients, employers, or other parties, it is your responsibility to ensure you have authorization to do so.
6. AI Processing and No Professional Advice
6.1 AI-Generated Outputs. DocSift uses artificial intelligence to extract data from your documents and answer questions about them. AI outputs are generated automatically and may contain errors, omissions, or inaccuracies.
6.2 No Guarantee of Accuracy. We do not guarantee the accuracy, completeness, or reliability of any AI-generated output. Extracted data fields, summaries, and chat answers are provided on a best-effort basis. You are responsible for reviewing and verifying all outputs before relying on them.
6.3 Not Professional Advice. DocSift is a document processing tool. It is NOT a legal, financial, medical, tax, or professional advisory service. Nothing produced by DocSift constitutes professional advice of any kind.
If you are a lawyer, accountant, healthcare professional, insurance agent, or other licensed professional, you are responsible for exercising your own professional judgment when using DocSift outputs. DocSift does not replace professional expertise, and no AI output should be treated as a substitute for qualified professional analysis.
6.4 No Liability for AI Outputs. We are not liable for any decisions you make, or any actions you take or fail to take, based on information produced by DocSift.
6A. Professional Use Disclaimer
DocSift is a document processing tool designed to help professionals work with documents more efficiently. It is NOT a substitute for professional judgment or advice in any field.
6A.1 Legal Professionals. DocSift does not provide legal advice. AI-extracted data from legal documents (contracts, court filings, regulatory documents) must be independently verified. DocSift does not replace attorney review and is not a substitute for qualified legal analysis.
6A.2 Financial and Tax Professionals. DocSift does not provide financial, tax, or accounting advice. AI-extracted financial data (amounts, dates, obligations) must be independently verified. DocSift makes no representations regarding compliance with the Gramm-Leach-Bliley Act (GLBA), Sarbanes-Oxley Act (SOX), or any other financial regulation.
6A.3 Healthcare Professionals. DocSift does not provide medical advice. See Section 7 (HIPAA Disclaimer) for important information about healthcare data.
6A.4 Real Estate Professionals. DocSift does not provide real estate advice. AI-extracted data from property documents, leases, or closing documents must be independently verified against original records and applicable state laws.
6A.5 General. If you operate in a regulated industry, you are solely responsible for determining whether your use of DocSift complies with applicable laws, regulations, and professional conduct rules. DocSift makes no representations regarding compliance with industry-specific regulations including but not limited to HIPAA, GLBA, SOX, FERPA, or state-specific professional conduct rules.
7. HIPAA Disclaimer
DocSift is NOT compliant with the Health Insurance Portability and Accountability Act (HIPAA). We do not sign Business Associate Agreements (BAAs).
If you are a covered entity or business associate under HIPAA, you are responsible for determining whether your use of DocSift complies with your HIPAA obligations. DocSift should not be used as a system of record for Protected Health Information (PHI).
8. Data Processing
We process your data as described in our Privacy Policy. Key points:
- Your uploaded documents are sent to Anthropic’s Claude API for AI analysis. Anthropic does not use your data to train their models.
- Your files are stored in private, encrypted cloud storage. No DocSift employee can view your documents.
- When you delete documents, they are permanently removed from our active systems. Database backups may retain copies for up to 30 days.
- You can export all your data or delete your account at any time.
9. Service Availability
We strive to keep DocSift available and reliable, but we do not guarantee uninterrupted or error-free service. We do not offer a Service Level Agreement (SLA) for Free or Pro plans.
We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
10. Changes to the Service
We may modify, update, or discontinue features of DocSift at any time. If we discontinue the Service entirely, we will give you at least 30 days’ notice and an opportunity to export your data.
11. Payment Terms
11.1 Billing. Paid plans are billed monthly. You authorize us to charge your payment method on a recurring basis until you cancel.
11.2 Cancellation. You may cancel your paid plan at any time. Cancellation takes effect at the end of your current billing period. You will not be charged again after cancellation.
11.3 Refunds. We do not provide refunds for partial billing periods. If you believe you were charged in error, contact us at support@doc-sift.com.
11.4 Price Changes.We may change pricing with at least 30 days’ notice. Price changes take effect at the start of your next billing cycle after the notice period.
12. Termination
12.1 By You. You may stop using DocSift and delete your account at any time. Upon account deletion, all your data is permanently removed per our Privacy Policy.
12.2 By Us. We may suspend or terminate your account if:
- You violate these Terms or the Acceptable Use Policy
- Your account is used for illegal activity
- You fail to pay applicable fees
- We are required to do so by law
If we terminate your account for reasons other than a Terms violation, we will give you reasonable notice and an opportunity to export your data.
12.3 Effect of Termination. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (including Sections 6, 7, 13, 14, 15, and 16) will survive termination.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
13.1 DocSift, its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
13.2 Our total aggregate liability for all claims arising from or related to these Terms or the Service is limited to the amount you paid to DocSift in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.
13.3 These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if DocSift has been advised of the possibility of such damages.
14. Indemnification
You agree to indemnify, defend, and hold harmless DocSift, its officers, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Documents you upload to the Service, including any claims that you lacked authorization to upload or process them
15. Governing Law and Disputes
15.1 Governing Law. These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
15.2 Dispute Resolution. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of these courts.
15.3 Informal Resolution First. Before filing any legal action, you agree to contact us at support@doc-sift.com and attempt to resolve the dispute informally for at least 30 days.
16. General Provisions
16.1 Entire Agreement. These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and DocSift.
16.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
16.3 No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
16.4 Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
16.5 Force Majeure. We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect.
Your continued use of DocSift after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you may close your account.
